Quisiera compartir mi situación personal con ustedes, el día 14 de febrero me traslado como al principio lo menciones al palacio de judicial del Estado Monagas al estar allí, Aproximadamente a las 2:30 dé la tarde, para saber de mi audiencia, pase por las diferentes salas del Palacio de Justicia, veo que estaban algunos funcionarios, y le preguntó al funcionario por el trasladado de mí defendiendo si los habían trasladado del centro penitenciario de oriente conocido como la pica, y me menciono que no lo trasladaron, desde que asumí la defensa aproximadamente ya 6 meses, no se ha dado la audiencia de apertura de juicio, por la misma razón, no han trasladado, ni una sola vez al palacio de justicia, a mi defendido siempre estoy pendiente a que salgan las boletas, pero nunca salen, converso, con la secretaria administrativa del tribunal y siempre me dice no se preocupe porque si va a salir la boleta, van más de 5 diferimientos, nunca me han podido trasladar a este imputado ni una sola vez desde que tengo la defensa, he hablado con los diferentes funcionarios y nada, y esto me trae una reflexión, porque yo puedo ver una hermosa estructura, pero Será que es solo un palacio de cristal y no de justicia, porque lo facil es tan dificil, me consta que todo no es malo hay muy buenos funcionarios y jueces, ¿ pero será suficiente? Las grandes expectativas, traen muchas veces grandes desilusiones, como en mi caso, hay algo estructural que hay que cambiar, si el acusado es culpable que sea juzgado y condenado y si es inocente, que sea absuelto, si le dicen mañana en juicio, usted es inocente, es necesario pasar muchos años para saber un veredicto es una gran pregunta, quien restituye, ese tiempo.

El estado a través de los legisladores, han creado una serie de mecanismos, que a mi parecer, es solo letra muerta, normas que regulan el retardo procesal en Venezuela, que no se cumplen, debería existir una aplicación real de la norma, pero solo la aplico a conveniencia, hay un ejemplo claro en audiencias, en el derecho laboral, las audiencias, no puedes faltar, porque de alguna manera eres sancionado o condenado si faltas a una audiencia pierdes prácticamente todo, debería existir una sanción en materia penal, para jueces, abogados, fiscales, que no acudan a las audiencias, sean sancionados, los abogados que falten a dos audiencias, sean revocados, a diferencia de la actualidad, no se da una audiencia no pasa nada, no se da la siguiente, no pasa nada, no hay algo real que pueda sancionar al culpable de que esa audiencia no se realice, cada diferimiento tiene que ser sancionables, la inspectoría de tribunales no ser una figura muerta, cada diferimiento, tiene que tener una investigación y determinar la culpa y establecer responsabilidades, es mi humilde opinión.
